USER AGREEMENT MYGAME

PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

This User Agreement ("Agreement"), together with any documents referenced herein, contains all of the terms and conditions that apply to purchases of MYGAME (the “Services”) described on this Internet website vision54.com (the “Site”), and on other related Internet websites (including without limitation golf54.com and coachingforthefuture.com, collectively referenced as the “Related Sites”) by you (“you” or “Customer”) from Coaching For the Future Inc (the "Service Provider"). By clicking “I accept”, Customer acknowledges that (s)he has reviewed and understands the terms and conditions in this Agreement, and Customer agrees to be bound by and accepts the terms and conditions in this Agreement.  If you do not agree to be bound by all of these Terms, please do not use or access this Site.  Service Provider reserves the right to cancel your membership, without refund of any moneys paid, should you violate any of the terms and conditions in this Agreement. 

As used in this Agreement, “Services” shall mean any and all goods, services, and/or information offered or communicated via this Site or any of the Related Sites.  These Services include, but are not limited to, communications, data, statements and information regarding golf; golf performance training and any other consultation, instruction or advice.

This User Agreement, and its terms and conditions, may be modified from time to time without prior notice and in Service Provider’s sole discretion.  Such modifications may include without limitation those related to the price of the Services, descriptions and other e-commerce related information and/or functionality.  The date of the most recent revisions will appear on this page. Continued access to and/or use of the Service by you will constitute your acceptance of any changes or revisions to the Agreement, whether or not you have fully reviewed any revisions on this page.  Service Provider reserves the right, its sole discretion, to discontinue the Site or Services and/or modify the contents of the Site.  You agree that Service Provider will not be liable to you for any such discontinuance or modification of the Site or the Services.   

Your failure to follow the rules, terms and conditions of this User Agreement, whether listed below or in bulletins posted at various points in the Service, may result in suspension or termination of your access to the Service, without notice, in addition to Service Provider's exercise other remedies available to it.

Rules, Terms and Conditions of Usage:

USE OF THE SERVICE BY YOU:

Service Provider grants you a limited, non-exclusive license to access and make personal use of the Site for legal purposes and uses and that are otherwise permitted by these Terms.  Other than page caching, you are not authorized to download or modify the Site or any portion of it.  This license does not include any resale or commercial use of this Site or its contents; any collection and use of any product listings, descriptions or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. 

Your right to use the Service is personal to you -- you may not authorize others to use the Service, and you are responsible for all use of the Service by you and by those you allow to use, or to whom you provide access to, the Service.

If you use the Site, you agree to accept responsibility for all activities that occur under your account or password.  Service Provider and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.  Memberships are non-transferable and may not be shared.  You agree to (a) maintain all equipment necessary for your access to and use of the Site; (b) maintain the security of your user identification, password, and any other confidential information relating to your MYGAME account; and (c) take responsibility for all charges resulting from use of your MYGAME account, including unauthorized use prior to your notifying MYGAME of such unauthorized use and taking the legal steps to prevent its further occurrence by contacting us to change your password.

Restrictions:

·                You agree not to use at the Site, or to place, post or transmit through the Site, any material that is unlawful, threatening, defamatory, abusive, harassing, vulgar, obscene, profane, indecent, hateful, offensive or otherwise objectionable. In addition, you agree not to use at the Site, or to place, post or transmit through the Site, any material that violates or infringes upon the rights of others. Further, you may not place on the Site any material that is encrypted, constitutes junk mail or unauthorized advertising or solicitation, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or that otherwise would violate any local, state, national or international law or regulation. You are also prohibited from using the Site or Services in any way that restricts or inhibits any other Site or Service user from using or enjoying the Site and/or Services.  You agree to use the Site and Service only for lawful purposes, and you acknowledge that your failure to do so may subject you to civil and criminal liability.

·                You are responsible for ensuring that any material you provide to the Service Provider or post at the Site, including but not limited to text, photographs and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any party and is posted with the permission of the owner(s) of such rights. Material on the Site is for your personal use only. The Site contains copyrighted and other proprietary information, which remain solely and exclusively in the possession of the legal owners of such information.  Service Provider may, in appropriate circumstances and at its discretion, suspend or terminate the access of and take other action against users, subscribers, registrants and account holders who infringe the copyright rights of others.

·                You may not in any way make commercial or other unauthorized use, by publication, re-transmission, distribution, performance, caching, or otherwise, of material obtained through the Site or Service, except as permitted by the Copyright Act or other law or as clearly, expressly and unequivocally permitted in writing by this Agreement, Service Provider or the Site.

·                You may not frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Service Provider, the Site or the Service.  You may not use any meta-tags or any other hidden text utilizing Service Provider's name or trademarks. Any unauthorized use terminates the permission and license granted by Service Provider. 

·                You agree not to disrupt, modify or interfere with the Site and/or Service or any associated software, hardware and/or servers in any way.  In addition, you agree not to impede or interfere with others' use of the Site and/or Service. You further agree not to alter or tamper with any information or materials on or associated with the Site and/or Service.
